Kordoglio: a Cossiga unanimously

265/2010 CONSTITUTIONAL COURT JUDGEMENT: THE DOCUMENT WAS RECEIVED FROM THE ROOMS OF THE CRIMINAL

Here is the document on the recent verdict of the Executive dell'UCPI No 265/2010 della Corte Costituzionale che ha dichiarato (parzialmente) illegittimo il c.d. "mandato di cattura" obbligatorio in materia di reati sessuali (la sentenza è scaricabile, fra l'altro, al seguente link: http://www.giurcost.org/decisioni/index.html).

Il Direttivo della Camera Penale di Bolzano auspica che il documento della Giunta, di altissimo valore scientifico e professionale, possa stimolare riflessioni ed osservazioni anche fra i propri Iscritti, tenuto conto dell'assoluta importanza - sul piano sostanziale e processuale - dei principi affermati dalla Corte Costituzionale nella citata sentenza del 7 luglio 2010.

"SENTENZA 265 DEL 2010:
LA PROPAGANDA GENERA ESTERNAZIONI SCOMPOSTE
MA LA MAGISTRATURA NE HA POSTO LE PREMESSE
La sentenza 265/2010 della Corte Costituzionale ha suscitato commenti scomposti e,come spesso accade, del tutto avulsi dalla portata reale dell’innovazione introdotta dalla pronuncia, anzi talvolta tali da palesare l’assoluta ignoranza del contenuto della decisione.
In realtà la Consulta ha soltanto introdotto un minimo, però significativo, di ragionevolezza costituzionale nell’odioso regime cautelare speciale dei reati c.d. “a cattura quasi obbligatoria”. Si è, infatti limitata a cancellare, con riguardo ai reati devoluti alla sua attenzione, non già la presunzione di esclusiva idoneità della misura cautelare estrema (il carcere), bensì il suo carattere di assolutezza ed invincibilità, anche quando nel caso concreto emergano specifici elementi che fanno ritenere idonea anche una diversa e più gradata misura (arresti domiciliari, obblighi di presentazione alla P.G., etc.).
Del resto, l’assolutezza di quella presunzione aveva passato il vaglio della CEDU esclusivamente per i reati di mafia “alla luce della natura specifica del fenomeno della criminalità organizzata e soprattutto di quella di stampo mafioso” in quanto la carcerazione “tende a tagliare i legami esistenti tra le persone interessate e il loro scope of criminal origin, in order to minimize the risk that they maintain personal contact with the structures of criminal organizations and will commit crimes in the meantime "(Case 6/11/2003, Pantano v. In fact, in this respect the decision provides an important and laudable rally in the cardinal principles of the Charter of Fundamental:
a) the presumption of innocence;
b) the illegality of a sentence without a conviction and disguised as a precautionary measure;
c ) the need for care in prison who must be presumed innocent is a last resort and not be implemented without any assessment of the case. Why bother

Tali interpretazioni non sono coerenti con la nostra Carta fondamentale e con le pronunce della CEDU.
Le fondamentali premesse della sentenza 265/2010 della Consulta rappresentano al riguardo un diverso e più garantista punto di riferimento. Auspichiamo che i Giudici ne tengano conto, operando quel controllo giurisdizionale sulle richieste del P.M. che troppo spesso è mancato e che lascia trasparire una intollerabile carenza di terzietà.

Pubblichiamo di seguito il verbale dell'ultima assemblea del 28.7.2010.

Today 28/07/2010 at 20.00 and met in Bolzano following the Ordinary General Meeting of the Criminal Chamber of Bolzano. The presidency of

was recruited by the Speaker of the House criminal lawyer. Migliucci Benjamin, who has appointed as Secretary-represented. Elena Valenti Att. Federico Fava, both members of the Executive Committee.


1) Report of the President.
The President took the floor and explained in its memorandum, the activities carried out by the Criminal Chamber, in particular with reference to the recent issue of abstention from criminal hearings opened (and then withdrawn) 7 to 14 July last.

The President also reiterated what has already been communicated to members by e-mail dd. 16.07.2010 in respect of requests / comments to the President of the Criminal Chamber of the Council of the Order to be submitted to the Judicial Council.

The President also addressed the issue of the recent "strike" ANM, illustrating the resolution adopted by the Criminal Chamber (formerly also communicated to members) and subsequent correspondence with the representative of the same subsection of the local ANM

The President, After explaining the reasons and procedures for use in relation to issues of local importance, has called on members to report, detail and in writing, any inefficiency of the courts and / or any serious incidents / faults that directly invest the fundamental rights of the accused, including the right course of defense, or otherwise adversely affect or compress the role of the defender.

Members: Mr. Mark and Mr. Boscarol Amanda Cheneri represented various issues relating to processes, whether administrative (expulsion) against non-EU citizens, urging intervention.

Several members have submitted to the attention of certain critical aspects of the proceedings before the Justice of the Peace (and especially of the detailed rules for the conduct of hearings).

Si è deciso di effettuare uno studio – di carattere scientifico/statistico - sulle sentenze penali del Giudice di Pace di Bolzano, registrando la disponibilità del collega Avv. Marco Boscarol del dott. Marco Nicolini per lo svolgimento dell’incarico.







2) Nomina delegati Congresso ordinario U.C.P.I.
Dopo breve illustrazione del Presidente delle due candidature alla Presidenza dell’U.C.P.I. che verranno presentate al prossimo congresso ordinario di Palermo, oltre che dei principali temi che verranno affrontati in quella sede, sono stati nominati i tre delegati della Camera Penale, ed in particolare:

1) Avv. Marco Boscarol;
2) Mr. Federico Fava
3) Mr. Dominic Laratta.


3) Establishment and organization of the local school. My colleague Claudia
Mr. Benedetti has succinctly explained, on the basis of previous experience, the main innovations of the new regulation dell'UCPI, also expressing their willingness to participate in the management committee of the institution of school planning.

It was also recorded its readiness in principle to some colleagues, and in particular: Mr. Marco Boscarol, Mr. Tito Boscarolli, Amanda Cheneri Lawyer, Attorney Ennemoser Angelika, Mr. Rudi Leoni, Marco Mayr Attorney, Lawyer Mara Uggè.


4) Meetings training for 2010/2011. Mr.

5) Update website. Mr.
. Federico Fava explained the various options, including economic, for updating or revision of the website. It was approved unanimously of those present, the purchase of a software solution for creating web sites, and then the subsequent creation of the same dependent Att. Federico Fava, possibly with the lawyer. Francesco Coran, who also stressed the need for different members can access (and change) of the Criminal Chamber of the site.


6) Adaptation of the Statute.
It was agreed, postponing the consideration of the merits of the issue at the next meeting, to amend the Criminal Chamber of the Statute in order to adapt to that dell'UCPI


7) Insert "ex officio" by the Council of the Order of the Defenders office in the lists of Justices of the Peace.
The question was raised and exhibited by Mrs Chambers. Claudia Benedetti.
It was decided to inform members of the decision of the council and, above all, to send a letter to the President pointing out the event.





After brief discussion the final at 22.30 the Chairman declared the meeting closed.
